Leave of Absence Process and Procedures

If you will be out of work, even if you have enough paid time available to cover your absence, you must complete the paperwork to request a leave of absence. Your pay and benefits may be affected if you fail to follow the correct Leave Procedures.  

Whether employees are paid during leave depends on the type of leave they are taking, available paid time they may have accrued, and their eligibility.  

Family Medical Leave Act (FMLA)

The Family Medical Leave Act (FMLA) gives eligible employees of a covered employer the right to take unpaid leave for up to 12 work weeks in any 12-month period. FMLA Leave is contingent on the following factors.

Eligible Employee

Employees must satisfy all of the following conditions to be eligible:

  • Employed by the employer for at least 12 months (whether consecutive or not)

  • Worked (as defined under the Fair Labor Standards' Act) at least 1,250 hours during the 12-month period immediately preceding the leave at the time it is requested

  • Employed at a work site where 50 or more employees are employed by the employer within 75 miles of the site

Qualifying Leave

FMLA allows eligible employees to take leave for any of the following reasons:

  • The birth of a child or the placement of a child for adoption or foster care

  • The employee is needed to care for a family member (child, spouse, or parent) with a serious health condition.

  • The employee's own serious health condition makes him or her unable to do his or her job.

Medical Leave

Employees who are unable to work due to a serious medical condition may request Medical Leave of Absence. Employees who work in positions that accrue sick leave or who are eligible for leave under FMLA will qualify for Medical Leave with or without pay. Medical Leave is granted only for employees’ serious health conditions. Employees may not take Medical Leave to care for family members. (See Family Leave below.)  For employees who qualify for FMLA in addition to Medical Leave, the two types of leave will run concurrently.

Adoption/Child Rearing Leave Without Pay

Employees may take up to two years of leave after the birth or adoption of a child—from the date of birth or adoption. An employee presenting the required evidence will, upon request, be granted an unpaid leave of absence necessary to meet child adoption requirements and for the purpose of rearing the preschool child or children. Single Adoption/Child Rearing Leave will be granted for a period of no less than 30 days and no more than 2 consecutive work years or major portions of them, upon written request by the employee. For employees who qualify for FMLA in addition to parental leave, the two types of leave will run concurrently.

Family Leave—Care for a Family Member

Employees may qualify for Family Leave to assist an immediate family member with a serious medical condition. Employees ineligible for FMLA Leave may be eligible for Family Leave. Immediate family is defined as a spouse, children (including step-children), parents, and a spouse’s parents without regard to the location of the relatives' residence. Employees who qualify may apply their Sick Leave toward their Family Leave. For employees who qualify for FMLA in addition to Family Leave, the two types of leave will run concurrently.

Professional Leave

Some employees serving in specific capacities with state or local organizations may request a Professional Leave of Absence. Such leaves must be approved prior to any travel and prior to the beginning of the term of service, and some cases may require the superintendent's approval. Professional leave is also required when traveling on official district business, using district funds for approved conferences or events, and other similar circumstances. Professional leave must be approved prior to traveling.  

JCPS employees seeking to use professional leave should complete and sign the electronic form and then route it to their immediate supervisor.  Much like the previous paper versions of the Professional Leave Form, it is the employee's responsibility to include appropriate documentation regarding the event (including how attendance supports the employee's contribution to the JCPS mission and vision). During the 2023-24 school year, substitute teachers will not be allowed Professional Leave requests except for supervision of students at official student organization events and competitions. Professional Leave Forms will only need to be routed to the Leave Center in the event that the employee is traveling while supervising students or an extenuating circumstance related to the instances mentioned above. Educational Leave

In some cases, requests for Educational Leave may be granted so employees can obtain additional education that will benefit them and JCPS. Employees must submit written requests before the course or program begins. Proof of enrollment and course of study must be attached to the request for leave.

Religious Observation Leave

An employee may wish to take an unpaid day to observe a religious holiday. The request must be submitted and approved to the Leave Center prior to taking days off. To apply, fill out the Religious Observation Leave (PDF).

Military Leave

Full- and part-time permanent employees who are called into active duty or active duty training may be eligible for Military Leave. Employees must provide copies of orders for Military Leaves to be processed. Employees’ rights to Military Leave are provided and protected under the Uniformed Services Employment and Reemployment Rights Act (USERRA) and other applicable federal and state laws.  

To apply for a Military Deployment Leave, you must fill out the Request for Military Leave Form (PDF). For all other military-related leaves, contact the Leave Center for the proper paperwork.

Our mission is to provide superior customer service by giving the support and guidance needed during the application process. We provide assistance with all applications for employment, conduct criminal background and child abuse and neglect checks, and answer general employment questions. Our hours of operation are Monday through Friday, 7:30 a.m. to 4:30 p.m. 

Affordable Care Act

Form 1095-C

JCPS employees will receive Form 1095-C as required by the Affordable Care Act (ACA). This form will report whether you were offered health insurance coverage, if the coverage was affordable according to ACA standards, and additional details about the health insurance coverage offered to employees. The 1095-C form will supplement but not replace your W-2. Please consult your tax professional for specific questions regarding how Form 1095-C will be used when filing your income tax return. Workers' Compensation

JCPS provides a Workers’ Compensation Program to all employees at no cost. Workers’ Compensation is paid 100 percent by the Jefferson County Board of Education (JCBE). If you are injured in the course and scope of your employment, you may be eligible for Workers’ Compensation benefits. These benefits may provide for the cost of related medical care and prescriptions as well as compensation for lost wages and other applicable benefits required by law.

Workers’ Compensation benefits are automatically coordinated with your accumulated sick leave; therefore, you will not receive an amount greater than 100 percent of your regular daily pay. If you do not have accumulated sick leave, you will only be eligible to receive up to 66 2/3 percent of your compensation benefits as required by state law.

If you are injured on the job, you must complete an Employee Illness/Injury Report at your work location as soon as possible within 72 hours of your injury/illness.
